Terms of Service

These Terms of Service ("Terms") govern your access to and use of [APP NAME], an estimating and quoting tool for home services businesses (the "Service"), provided by [BUSINESS NAME] ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
## 1. Who May Use the Service
The Service is intended for use by home services businesses ("Business Users") and staff members they invite. You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
## 2. Description of the Service
The Service allows Business Users and their staff to generate property estimates using job details and property data, deliver those estimates to their customers, and optionally push finished quotes into a connected third-party CRM (such as Jobber). Pricing rules configured by a Business User are private to that business and are not shared with other Business Users or exposed to end customers — only the calculated estimate total is shared with the end customer.
## 3. Accounts and Roles
Each Business User account may have an "Owner" and one or more "Staff" members, invited by the Owner. Owners have access to the business's pricing configuration; Staff can generate estimates but do not have access to the underlying pricing rates. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
## 4. Subscription Plans and Billing
**Plans.** The Service is offered on a tiered subscription basis. Current plan details, included estimate volume, and pricing are available at [PRICING PAGE URL].
**Per-estimate charges.** Estimates generated beyond a plan's included monthly volume are billed at the applicable per-estimate rate for your plan (currently $2.00 / $1.50 / $1.00 depending on plan tier — see pricing page for current rates).
**Billing cycle.** Subscriptions are billed monthly in advance. Per-estimate overage charges, if any, are billed in arrears at the end of each billing cycle.
**Changes to pricing.** We may change our subscription fees or per-estimate rates with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
**Non-payment.** We may suspend or terminate access to the Service if fees are not paid when due.
## 5. Third-Party Integrations
**CRM connections.** If you connect a third-party CRM (such as Jobber) to your account, you authorize us to create and manage quotes in that system on your behalf. You may disconnect this access at any time from your account settings.
**Property data providers.** The Service uses third-party providers (including RentCast and Google Maps) to retrieve and verify property information. We do not control and are not responsible for the accuracy of data provided by these third parties. Estimates generated using this data are provided as a convenience and should be independently verified before being treated as final for billing or contractual purposes.
## 6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access another Business User's pricing rules, estimates, or account data
- Attempt to bypass, probe, or interfere with the Service's security measures
- Use the Service to generate estimates using property or customer data you do not have the right to use
- Resell or provide access to the Service to third parties outside your own business without our consent
## 7. Intellectual Property
We retain all rights, title, and interest in the Service, including its software, design, and underlying technology. You retain ownership of the pricing rules, estimates, and customer information you input into the Service.
## 8. Disclaimers
The Service, including any property data or estimates it generates, is provided "as is" without warranties of any kind, express or implied. We do not guarantee that property data retrieved from third-party sources is accurate, complete, or current. Estimates generated through the Service are tools to assist your business and do not replace your own professional judgment or verification.
## 9. Limitation of Liability
To the maximum extent permitted by law, [BUSINESS NAME] will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.

You may cancel your subscription at any time from your account settings. We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, your right to use the Service ends, though these Terms will continue to apply to any prior use.
